Types of Residency in Egypt

Egyptian law is clear on one point: under Article 16 of Law No. 89 of 1960 (the law governing the entry and residence of foreigners), every foreigner must hold a residence permit. There is no legal "grey zone" — staying without a valid permit exposes you to fines and, in serious cases, deportation orders.

Article 17 of the same law divides residence into four categories: special residence, ordinary residence, temporary residence, and deposit-based residence. In practice, most foreigners will deal with one of these:

  • Tourist residence: the entry stamp or tourist visa most visitors arrive on. It is short-term and cannot be used for work. Many foreigners start here and then convert to a longer-term category — but the conversion has deadlines, and missing them means fines calculated per day of overstay.
  • Work residence: tied to a work permit issued through your Egyptian employer. The permit and the residence are linked — lose the job, and the residence basis disappears with it unless you convert to another category in time.
  • Study residence: for students enrolled at recognized Egyptian universities and institutes, renewed annually against proof of enrollment.
  • Marriage and family residence: available to foreign spouses of Egyptian nationals and, in defined cases, to their children. Documentary requirements are strict — marriage certificates, in particular, must be properly legalized.
  • Investment and property-based residence: foreigners who invest in Egypt or purchase property can qualify for residence on that basis, subject to minimum thresholds set by the authorities.

Under Article 20, temporary residence is granted for a maximum of one year, renewable. Buying Property in Egypt as a Foreigner

Foreigners can own property in Egypt, but within strict statutory limits. Article 2 of Law No. 230 of 1996 (ownership of real estate by non-Egyptians) provides that a non-Egyptian may own at most two properties anywhere in the country, for the private residence of himself and his family, that each property may not exceed 4,000 square meters, and that the property may not be an antiquity (heritage-listed).

Beyond these limits, the single most important rule is the same one that applies to Egyptians: an unregistered sale contract does not transfer ownership. Under Article 9 of the Real Estate Registration Law No. 114 of 1946, registration is the condition for transferring title to real estate. A private (customary) contract only creates a personal obligation on the seller — it does not make you the owner in the eyes of the law.

Common Legal Problems Foreigners Face in Egypt

In our practice, the same four problems recur:

  • Overstayed residency and fines: the most common issue, usually from missed renewal deadlines. Fines accumulate, and unresolved overstays can block future re-entry. The fix is almost always administrative — file correctly and pay what is due — but it must be done before the situation escalates.
  • Buying with unregistered contracts: a foreigner pays for an apartment, holds a private contract, then discovers the seller sold the same unit twice — or that the "owner" was never the registered owner at all. Recovery litigation is possible but slow; prevention through title verification is infinitely cheaper.
  • Rental disputes: Egypt's rental market mixes old-law and new-law tenancies, and foreign tenants are sometimes given informal or bilingual contracts with contradictory terms. Under Article 558 of the Egyptian Civil Code, a lease is a contract obliging the landlord to enable the tenant's use of a specific thing for a defined period for a known rent — know which version of your contract controls before you sign.
  • Bounced cheques and unpaid debts: cheques are widely used in Egyptian business, and issuing a cheque without sufficient funds is a criminal offense punishable by imprisonment and a fine of up to EGP 50,000 (Article 534, Commercial Law No. 17 of 1999). Foreign businesspeople sometimes sign cheques as guarantees without understanding the exposure.

Can I live in Egypt long-term on tourist visas?

No — not legally. Every foreigner must hold a residence permit (Article 16, Law 89/1960), and repeated tourist-visa runs do not create a lawful long-term status. As a foreigner, how many properties can I buy in Egypt?

أنواع الإقامة في مصر وشروطها

القانون المصري واضح في نقطة أساسية: المادة 16 من القانون رقم 89 لسنة 1960 (قانون دخول وإقامة الأجانب) بتنص على إنه «يجب على كل أجنبي أن يكون حاصلاً على ترخيص بالإقامة». مفيش منطقة رمادية — الإقامة من غير ترخيص ساري بتعرضك لغرامات، وفي الحالات الجسيمة لقرارات إبعاد.

المادة 17 من نفس القانون بتقسم الإقامة لأربع فئات: إقامة خاصة، وإقامة عادية، وإقامة مؤقتة، وإقامة بوديعة. وفي الواقع العملي، أغلب الأجانب بيتعاملوا مع واحدة من الحالات دي:

  • الإقامة السياحية: ختم الدخول أو التأشيرة السياحية اللي بيدخل بيها أغلب الزوار. مدتها قصيرة ومش صالحة للعمل. كتير من الأجانب بيبدأوا بيها وبعدين يحولوا لفئة أطول — لكن التحويل ليه مواعيد، والتأخير عنه معناه غرامات بتتحسب عن كل يوم تجاوز.
  • إقامة العمل: مرتبطة بتصريح العمل اللي بيطلعه صاحب العمل المصري. الترخيص والإقامة مرتبطين ببعض — لو الشغل انتهى، سند الإقامة بينتهي معاه ما لم تحول لفئة تانية في الوقت المناسب.
  • إقامة الدراسة: للطلبة المقيدين في الجامعات والمعاهد المصرية المعترف بيها، وبتتجدد سنويًا بموجب إثبات القيد.
  • إقامة الزواج والأسرة: متاحة للزوج الأجنبي للمواطن المصري وفي حالات محددة لأبنائهم. المستندات المطلوبة صارمة — وشهادات الزواج بالذات لازم تكون موثقة وتُصدَّق بشكل سليم.
  • إقامة الاستثمار وتملك العقار: الأجنبي اللي بيستثمر في مصر أو بيشتري عقار ممكن يحصل على إقامة على هذا الأساس، وفق الحدود الدنيا اللي بتحددها الجهات المختصة.

تملك الأجانب للعقارات في مصر

الأجنبي يقدر يتملك عقار في مصر، لكن في حدود قانونية صارمة. المادة الثانية من القانون رقم 230 لسنة 1996 (تملك غير المصريين للعقارات) بتنص على إنه يجوز لغير المصري تملك عقارين على الأكثر في جميع أنحاء الجمهورية بقصد السكنى الخاصة له ولأسرته، وألا تزيد مساحة كل عقار على أربعة آلاف متر مربع، وألا يكون العقار أثرًا.

وفوق الشروط دي، أهم قاعدة هي نفسها اللي بتطبق على المصريين: عقد البيع غير المسجل لا ينقل الملكية. وفقًا للمادة 9 من قانون الشهر العقاري رقم 114 لسنة 1946، التسجيل هو شرط نقل ملكية العقار. العقد العرفي (الابتدائي) بينشئ التزام شخصي على البائع بس — مش بيخليك مالك في نظر القانون.

نصيحتنا المعتادة للمشتري الأجنبي، بالترتيب:

  • افحص تسلسل الملكية قبل ما تدفع أي مبلغ — مين المالك المسجل؟ وهل تسلسل التصرفات السابقة سليم؟
  • تأكد من عدم وجود أعباء — رهون أو حجوزات أو نزاعات مسجلة على العقار.
  • تأكد إن العقار مش أثر وإنه داخل حدود المساحة والعدد اللي حددها القانون 230 لسنة 1996.
  • سجّل العقد — خصص وقت ومصاريف لإجراءات التسجيل؛ دي اللي بتخليك المالك فعلاً.

أشهر المشاكل القانونية اللي بيواجهها الأجانب وحلولها

في شغلنا اليومي، نفس أربع مشاكل بتتكرر مع العملاء الأجانب:

  • تجاوز مدة الإقامة والغرامات: أشهر مشكلة، وغالبًا سببها نسيان موعد التجديد. الغرامات بتتراكم، والتجاوز غير المسوّى ممكن يمنعك من دخول مصر تاني. الحل غالبًا إداري — قدّم صح وسدّد المستحق — لكن لازم يتم قبل ما الوضع يتصاعد.
  • الشراء بعقود غير مسجلة: أجنبي يدفع تمن شقة ويحتفظ بعقد ابتدائي، وبعدين يكتشف إن البائع باع نفس الوحدة مرتين — أو إن «المالك» مكنش المالك المسجل أصلاً. التقاضي لاسترداد الحق ممكن لكنه بطيء؛ الوقاية بفحص الملكية أرخص بكتير.
  • نزاعات الإيجار: سوق الإيجار المصري فيه نظامين (القديم والجديد)، وأحيانًا المستأجر الأجنبي بياخد عقد غير رسمي أو ثنائي اللغة ببنود متناقضة. والقاعدة في مادة 558 من القانون المدني: «الإيجار عقد يلتزم المؤجر بمقتضاه أن يمكن المستأجر من الانتفاع بشيء معين مدة معينة لقاء أجر معلوم» — اعرف أنهي نسخة من العقد هي الحاكمة قبل التوقيع.
  • الشيكات المرتجعة والديون غير المسددة: الشيك مستخدم بكثافة في التعاملات بمصر، وإصدار شيك بدون رصيد جريمة عقوبتها الحبس وغرامة تصل لخمسين ألف جنيه (مادة 534 من قانون التجارة رقم 17 لسنة 1999). بعض رجال الأعمال الأجانب بيوقعوا شيكات كضمان من غير ما يفهموا حجم المسؤولية.
